INFORMATION CLAUSE ON THE PROCESSING OF PERSONAL DATA FOR THE PURPOSE OF MARKETING PRODUCTS OR OWN SERVICES IN THE FORM OF MAILING

Who is the Personal Data Administrator?

The administrator of personal data processed in connection with the recruitment procedures is POSideo sp. Z oo with its registered office at ul. Rejowiecka 181, 22-100 Chełm. You can contact the Administrator by traditional mail or by e-mail at rodo@posideo.com

The basis and purpose of processing 

Your personal data, including the name, surname, e-mail address, position, name and address of the entity (if applicable) will be processed on the basis of the Controller's legitimate interest in order to conduct marketing activities regarding the Controller's products or services.

The legal basis for the processing of personal data is the provision of art. 6 sec. 1 letter f) of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to
with the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (General Data Protection Regulation) (Text with EEA relevance, hereinafter: GDPR), which enables data processing when it is necessary for the implementation of legitimate interests of the Administrator. The purpose of data processing is to conduct marketing activities regarding the Administrator's products or services. 

You have the right to object to the processing of data for the purpose set out above. This right can be exercised by clicking on the link provided in the body of the e-mail: unsubscribe from the mailing list.

Time of data processing 

Your personal data will be processed for the duration of the marketing campaign by the Administrator, no longer than 3 months from the date of their collection, subject to a situation where, as a result of the campaign, a contract between the parties is concluded and implemented or other relationships are created, e.g. in the field of defense or pursuing claims. In these situations, personal data will be processed for the time necessary to complete the new purpose of their processing.  

Data source 

Please be advised that your data has been obtained from public databases located on the Internet or obtained directly from you during business meetings. 

Data recipients 

We may transfer your personal data to the entity that provides us with the automated sending of marketing messages, IT services or when the provision of data is necessary to meet the requirements of applicable law, regulations or legal processes and requests from state institutions or when providing data to the recipient this data results from the request of the data subject.

Permissions 

You have the right to: access your personal data, request their rectification, request restriction of their processing, request the deletion of personal data and object to the processing of your personal data.

Automated decision making 

Your personal data will not be used for automated decision making, including profiling.

Right to lodge a complaint

If you believe that your personal data is being processed unlawfully, you have the right to lodge a complaint with the supervisory body - the President of the Office for Personal Data Protection.

The right to access data

You have the right to request access to your personal data, including in particular information
about whether we process your personal data and about the scope of data held by us, the purposes of data processing or categories of recipients of your data, if possible, about the planned period of data storage, about your rights regarding personal data, information about the sources of their acquisition in the event of when they have not been collected from you. Moreover, you have the right to obtain a copy of the data.

The right to rectify data

In a situation where your personal data held by us is inconsistent or incorrect, you have the right to request rectification.

The right to delete data (the right to be forgotten)

You have the right to request the deletion of your data if one of the following circumstances applies:

  1. personal data are no longer necessary for the purposes for which they were collected or otherwise processed;
  2. You have filed an effective objection to the processing;
  3. the personal data has been processed unlawfully;
  4. personal data must be deleted in order to comply with a legal obligation;
  5. You have revoked your consent to the processing of personal data, and the personal data was processed on the basis of your consent and there is no other legal basis for their processing.

However, you will not be able to exercise the right to delete data, e.g. if such data is necessary to establish or pursue claims or defend against claims, or if the processing is based on the provisions of applicable law.

The right to limit data processing

You have the right to request the restriction of processing in the following cases: 

  1. if you contest the correctness of personal data - for a period allowing for the verification of the correctness of such data; 
  2. the processing is unlawful and you oppose the erasure of the personal data and request the restriction of their use instead; 
  3. we no longer need personal data, but you need it to establish, investigate or defend against claims; 
  4. in the event of an objection by you - until it is determined whether the legally justified grounds on our side override the grounds of your objection.

The right to data portability

You have the right to receive your personal data in a structured, commonly used and machine-readable format and you have the right to send this personal data to another administrator if: 

  1. the processing takes place on the basis of your consent or on the basis of a contract with you, a 
  2. at the same time, the processing is carried out in an automated manner. 

At the same time, you have the right to request that personal data be sent directly to another data administrator, if technically possible.

The right to object to data processing

You have the right to object at any time - for reasons related to your particular situation - to the processing of your data, if the legal basis for processing is the legitimate interest of the Administrator.

As a result of the objection, we will cease to process your personal data, unless we demonstrate the existence of valid, legally justified grounds for processing that override your interests, rights and freedoms, or grounds for establishing, pursuing claims or defending against claims.

If your personal data is processed for direct marketing purposes, you can object to such processing at any time, including profiling, without having to show reasons related to your particular situation.

Right to withdraw consent

You have the right to withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of the processing which was carried out on the basis of consent before its withdrawal.

The right to lodge a complaint with the supervisory authority

You have the right to lodge a complaint with the President of the Personal Data Protection Office if you believe that we are processing your personal data in violation of the provisions. You can find all the necessary information on www.uodo.pl.
